The patent system is a reward mechanism for pharmaceutical innovation and the substantial R&D investments made by drug companies. The legal monopoly granted by patents effectively prevents generic competition for years or even decades, allowing pharmaceutical companies to maintain drug prices far higher than they would be without patent protection.

Strategic decisions by corporate executives are often closely tied to the patent lifecycle of blockbuster drugs. Ahead of the so-called 'patent cliff'—when patent expirations trigger a flood of generic competitors—companies typically bolster their product pipelines by increasing R&D investment, bringing in experimental therapies, or acquiring other drugmakers.

Within this decade, the pharmaceutical industry is facing a major patent cliff. It is estimated that by 2030, more than $200 billion in annual revenue will be at risk. This will force companies to make major decisions: continue pouring more funds into R&D, or mitigate the crisis through M&A deals?

Below, BioPharma Dive has compiled the upcoming expiration dates of key patents protecting the top 50 best-selling drugs, based on 2025 sales. The looming patent cliff for big pharma

The standard term for a U.S. patent is 20 years. Drug companies typically apply for patents before receiving regulatory approval, meaning the actual period of market exclusivity for a drug may be shorter than 20 years.

However, companies can use various strategies to make up for this time gap. For example, combining different types ofregulatory exclusivities, applying for so-calledpatent term restoration, or building thickets of multiple patents around various aspects such as dosing regimens and injection devices.

These patent thickets—now a focus of U.S. government scrutiny—can sometimes delay generic competition for twenty years or more. For example, Enbrel, an inflammatory disease drug sold by Amgen, will enjoymore than 30 years of market exclusivity

Methodology notes

To build this database, BioPharma Dive compiled the top 50 drugs by global sales in 2025, then searched for expiration dates of patents and other forms of legal market exclusivity disclosed by their manufacturers in regulatory filings. Information sources typically include annual Form 10-K reports filed with the U.S. Securities and Exchange Commission. If such information was not provided in company filings, the latest expiration date of the drug substance patent in the FDA Orange Book was used as a substitute.

This database is not an exhaustive list of all patents for brand-name drugs. It reflects, as of December 31, 2025, companies' own expectations of when competition may emerge in the U.S. or European markets due to the expiration of core patents.

The intellectual property involved here is typically the so-called 'composition of matter' patent, which relates to the drug's core ingredient and provides the broadest protection. When multiple patents with different expiration dates exist, BioPharma Dive uses the expiration date of the composition of matter patent.

Companies can apply for patent term extension in the U.S. or a supplementary protection certificate in the EU. Where applicable, BioPharma Dive has used the dates after such extensions.

Patent expiration information for some drugs does not cover the EU market, and patents for two other drugs have already expired. Roche did not disclose patent expiration information for its multiple sclerosis drug Ocrevus in its filings or in response to BioPharma Dive inquiries, so estimates from investment bank Leerink Partners were used.

This database also does not fully account for court rulings, or the possibility that additional formulation, manufacturing, and other patents could extend market exclusivity. BioPharma Dive will update the database as such events occur.

When companies report data in currencies other than U.S. dollars, BioPharma Dive converts using the annual average exchange rate disclosed by the relevant company; if not disclosed, it uses theannual average exchange rates published by the U.S. Internal Revenue Service
